Terms of Service
Effective date: April 4, 2026
These Terms of Service ("Terms") govern your access to and use of the FixItBid platform, including our website, web application, and all related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Who We Are
FixItBid operates a two-sided marketplace that connects homeowners seeking home repair and improvement services ("Homeowners") with independent contractors ("Contractors"). FixItBid is not a contractor and does not perform any services. We facilitate connections and handle payments but are not a party to any service agreement between Homeowners and Contractors.
2. Eligibility
You must be at least 18 years old and legally capable of entering into binding contracts to use the Service. By creating an account, you represent and warrant that you meet these requirements. Accounts registered on behalf of a business must be authorized by that business.
3. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@fixitbid.app of any unauthorized use of your account. FixItBid is not liable for any loss or damage arising from your failure to maintain account security. You may not share your account with any third party.
4. Homeowner Terms
Homeowners may post job listings describing home repair or improvement work needed. By posting a job, you represent that the job description is accurate to the best of your knowledge. You agree to fund escrow in the amount of the accepted bid before work begins. You may not post jobs that are illegal, fraudulent, or violate any applicable law. FixItBid reserves the right to remove any job listing at its sole discretion.
5. Contractor Terms
Contractors must submit valid proof of business license and insurance before submitting bids. Providing false or outdated documents is grounds for immediate account termination. By submitting a bid, you represent that you are qualified to perform the described work, that your pricing is accurate, and that you intend to complete the job if the bid is accepted. Contractors are independent contractors, not employees of FixItBid.
6. Escrow Payments
When a Homeowner accepts a bid, payment is processed via Stripe and held in escrow by FixItBid until the Homeowner marks the job as complete. Funds are not accessible to the Contractor until released. FixItBid charges a platform service fee, displayed before payment is processed, which is non-refundable except as stated in our dispute resolution policy. Contractors receive payouts within 2–5 business days of release. FixItBid uses Stripe for payment processing and is not responsible for Stripe service interruptions.
7. Dispute Resolution
If a Homeowner is unsatisfied with completed work, they may open a revision request or formal dispute from their dashboard. The Contractor has 72 hours to respond. If the dispute cannot be resolved between the parties, either party may escalate to FixItBid for review. FixItBid will review available evidence and make a binding decision regarding escrow release within 5 business days of escalation. FixItBid's decision regarding disputes is final.
For claims that cannot be resolved informally, you agree to binding arbitration under the rules of the American Arbitration Association (AAA). You waive any right to participate in a class action lawsuit against FixItBid.
8. Prohibited Conduct
You agree not to: (a) post false, misleading, or fraudulent content; (b) circumvent the platform by transacting with users met on FixItBid outside the platform; (c) harass, threaten, or discriminate against other users; (d) attempt to gain unauthorized access to any part of the Service; (e) use the Service for any unlawful purpose; (f) reverse-engineer, scrape, or copy any part of the platform.
9. Reviews and Content
Users may submit reviews after a job is completed. Reviews must be honest, based on direct experience, and not defamatory. FixItBid reserves the right to remove reviews that violate these guidelines. By submitting content to FixItBid, you grant FixItBid a non-exclusive, royalty-free, worldwide license to display and use that content in connection with operating the Service.
10. Disclaimers and Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. FIXITBID DOES NOT GUARANTEE THE QUALITY, SAFETY, OR LEGALITY OF WORK PERFORMED BY CONTRACTORS, OR THE ACCURACY OF JOB LISTINGS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIXITBID'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE FEES PAID TO FIXITBID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.
11. Termination
FixItBid reserves the right to suspend or terminate any account at any time for violation of these Terms, fraudulent activity, or for any other reason at its sole discretion. Upon termination, your right to use the Service ends immediately. Sections 7, 10, and 12 survive termination.
12. Governing Law
These Terms are governed by the laws of the State of Illinois, without regard to conflict of law principles. Any legal proceedings not subject to arbitration shall be brought exclusively in the state or federal courts located in Cook County, Illinois.
13. Changes to These Terms
FixItBid may update these Terms at any time. We will notify registered users by email or in-app notice at least 14 days before material changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
